- Action Directed To: Administrative Court, Royal Courts of Justice ([email protected]).
- Claimant: WASEEM MALIK
- Defendant(s): Thames Valley Police & Berkshire Magistrates' Court
- Referenced Case: CRLC25009759
- Subject: Urgent Judicial Review – Challenge to Unlawful Order Issued by Berkshire Magistrates' Court
- Details of My Judicial Review Application:
- Stated I am submitting a formal legal challenge regarding the "unlawful transformation of a void bail condition into a court order by Berkshire Magistrates' Court on 19/05/2025." (This refers to the order in Log #293 which removed all bail conditions but still mandated police station attendance on 02/07/2025).
- Grounds for Challenge Asserted:
- Procedural Defect – Unnamed & Unsigned Order: The court order allegedly lacks a judicial signature and does not identify the presiding magistrate, violating procedural requirements and rendering the order invalid.
- Jurisdictional Overreach – Bail Condition vs. Court Order: Argued the police station attendance requirement was originally a bail condition which was removed on 19/05/2025. Stated Berkshire Magistrates' Court unlawfully converted this void bail condition into an order despite having no jurisdiction to impose new restrictions after bail was removed.
- Violation of Article 5 ECHR – Right to Liberty: The unsigned, unnamed order unlawfully restricts my liberty. Asserted no lawful basis exists for TVP to enforce attendance on 02/07/2025.
- Violation of Article 6 ECHR – Right to a Fair Trial: The failure to process my subsequent bail variation application (Log #368) obstructs procedural fairness and denies me access to justice.
- Relief Sought:
- Declare the 19/05/2025 order VOID due to procedural defects.
- Suspend the 02/07/2025 police station attendance requirement immediately.
- Order Thames Valley Police to cease enforcement actions based on the void order.
- Award costs.

- My Perception of Purpose & Impact:
- My purpose was to formally apply for an urgent Judicial Review by the Administrative Court to challenge the legality and procedural integrity of the Berkshire Magistrates' Court order of May 19, 2025.
- I sought immediate interim relief (suspension of the attendance requirement) and a final declaration that the order was void.
- This was a critical legal step to rectify what I perceived as an unlawful restriction on my liberty and a denial of due process.
