IN THE COURT OF APPEAL (CRIMINAL DIVISION)
ON APPEAL FROM THE CROWN COURT AT READING
Case No: 43SW0138521
Court of Appeal Ref: 202502956 A3
BETWEEN:
THE KING
WASEEM MALIK
Appellant
AFFIDAVIT OF WASEEM MALIK
I, WASEEM MALIK, of [Your Full Address], Litigant in Person, SOLEMNLY AND SINCERELY AFFIRM as follows:
1. Introduction
1.1. I am the Appellant in the above-mentioned matter. This Affidavit is made in support of my Notice of Motion to Vacate Guilty Plea, filed concurrently. The facts deposed to herein are true and within my own knowledge, unless otherwise stated.
2. The Circumstances of the Guilty Plea
2.1. On or about 2 August 2024, I entered a plea of guilty before the Reading Crown Court. I affirm that this plea was not voluntary, informed, or unequivocal.
2.2. I was under extreme psychological duress at the time, suffering from severe insomnia, chronic pain, and mental anguish, as documented in my contemporaneous medical records (see Exhibit WM1). My capacity for rational judgment was profoundly impaired.
2.3. I felt compelled to plead guilty due to a combination of factors, including but not limited to: the systemic pressure from ongoing legal harassment, a feeling of utter helplessness against the combined power of the state and its agents, and the failure of legal representation to adequately advise me of my options or to challenge evidentiary flaws.
3. The Foundation of Fraud and Abuse of Process
3.1. The prosecution's case was built upon a fraudulent and misleading narrative. This includes, but is not limited to, false statements and the withholding of exculpatory evidence by Thames Valley Police.
3.2. I have documented over 350 instances of institutional failure, harassment, and procedural abuse (the "Phoenix Archive Logs"), which created the conditions of coercion that led to my plea. A summary and key logs are provided in Exhibit WM2.
