- Incident Type: Formal Demand for Charging Decision Sent to Police (Re: Racially Aggravated Threats to Life).
- Action Taken By: Myself (WASEEM BEY).
- Action Directed To: PC Daniel Thomas (Investigating Officer for CRN 43250203109).
- Cc: TVP Professional Standards, Kennedys Law LLP, Jack Rankin MP.
- Subject: Formal Demand: Charging Decision Required – Racially Aggravated Threats to Life (CRN 43250203109)
- Details of My Communication Sent:
- Formally submitted the signed witness statement from Mr. Shujah Gillani, stating it provides "irrefutable evidence" of a Racially Aggravated Threat to Kill and a Public Order offence committed by Chris of 1 Vaughan Gardens on 17/12/2024.
- Demanded Specific Actions pursuant to the Code for Crown Prosecutors (Threshold Test):
- An immediate charging decision against the suspect within 48 hours.
- Written confirmation of either the charge authorization OR a full explanation for any delay/non-prosecution.
- Outlined Consequences of Inaction: Warned that failure to respond substantively within the 48-hour deadline will trigger:
- An IOPC referral for investigative failure.
- A Judicial Review pre-action protocol for unreasonable delay.
- An MP-led Home Office inquiry into TVP's hate crime prosecution rates.
- My Perception of Purpose & Impact: This action puts the investigating officer and TVP on a strict clock. By providing irrefutable witness evidence and citing the CPS Code, I am forcing them to either act on a serious hate crime or provide a legally justifiable reason for their failure to do so, with clear consequences for continued inaction.
- Evidence: Saved copy of the email sent to PC Thomas and the attached "Statement of Shujah Gillani.pdf".
